Welcome to Hikayatna! These Terms of Service ("Terms") constitute a legally binding agreement between you and Pragsys ("Company," "we," "our," or "us") regarding your use of the Hikayatna mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OR COMPLETENESS OF CONTENT.

We do not warrant that the App will be uninterrupted, secure, or error-free; that results from using the App will be accurate or reliable; that defects will be corrected; or that the App is free of viruses or harmful components.

We do not endorse or guarantee the accuracy, completeness, or usefulness of any User Content. You are solely responsible for your use of User Content and your interactions with other users.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PRAGSYS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

Indemnification

You agree to indemnify, defend, and hold harmless Pragsys and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the App, your User Content, your violation of these Terms, your violation of any third-party rights, or your violation of any applicable law.

Before filing a formal dispute, you agree to contact us at support@hikayatna.com to attempt to resolve the dispute informally. We will try to resolve your concern within 30 days.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Jurisdiction

For any disputes not subject to arbitration, you agree to submit to the personal and exclusive jurisdiction of the courts located in Delaware, United States.

Class Action Waiver

YOU AND PRAGSYS AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Changes to Terms

We may update these Terms from time to time. When we do, we will post the updated Terms in the App, update the "Last Updated" date at the top, and for material changes provide notice through the App or via email. Your continued use of the App after changes become effective constitutes your acceptance of the updated Terms.

General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pragsys regarding the App. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision does not constitute a waiver. You may not assign your rights or obligations under these Terms without our consent.

Provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination of these Terms.
